Don Omar has initiated legal proceedings against Cesar Pina, an associate of DJ Envy, citing the unauthorized use of his images on a real estate website.
In the lawsuit filed on Tuesday, December 19, Omar alleges misappropriation, violation of the right to publicity, defamation, false light, fraud, and various torts related to the use of his likeness on the platform.
According to legal documents, a cease-and-desist letter was issued to Pina on December 4, requesting the removal of the images. However, Pina purportedly refused to comply, leading to the legal action. While the website now displays an error code, Pina’s Instagram account remains active. It’s noteworthy that DJ Envy is not implicated in the lawsuit.
Omar’s legal action follows a previous lawsuit where he accused Pina of deceiving him in a fraudulent real estate deal. The artist claimed to have invested in properties under Pina’s real estate company, alleging that despite spending $2 million on one deal, he received no relevant documents regarding the acquisition, renovation, and rental of the properties.
In light of these allegations, Omar is seeking $5 million in damages.
Pina faced legal trouble in October when he was arrested for allegedly conducting a multimillion-dollar Ponzi scheme.
“DJ Envy’s attorney’s defense that DJ Envy is a victim—that’s the dumbest shit I ever heard in my life,” Pena said. “Me and him were partners in the real estate seminars, we were partners in a couple of real estate transactions. That’s it. He’s not a victim. He was my partner, he was an investor.”
